If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not access or use the Services.

2. Scope of the Services

“Services” means all products and services provided by Bites.com, including but not limited to:

• ● CRM, ERP, accounting, tax workflow, payroll, HR, warehouse, and inventory modules
• ● Email, messaging, contact center, and communication modules
• ● Project, task, production, content, event, and studio management tools

• ● Document and content builders (proposals, reports, websites)
• ● API access, webhooks, developer tools, and integrations
• ● Bites Box and on-premise/offline modules
• ● Home Assistant and IoT integrations
• ● AI-powered analytics, search, recommendations, and automation

Certain Services or modules may have Service-Specific Terms. If they conflict with these Terms, Service-Specific Terms apply.

3. Accounts, Workspaces, and Customers

To access the Services, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials. Workspaces are controlled by the Customer, who manages roles, access, and permissions.

4. Customer Data

Customer retains ownership of all data stored in the Services. Bites.com processes Customer Data solely to operate and improve the Services, or as required by law.

5. Use of AI and Automation Features

AI features may include summarization, extraction, recommendations, analytics, and more. AI Output may be inaccurate or incomplete and should be reviewed before use.

6. Acceptable Use

You agree not to use the Services in a way that:

• ● Violates any law or third-party rights
• ● Uploads malicious code or attempts unauthorized access
• ● Interferes with the Service’s operation
• ● Sends spam or abusive content
• ● Attempts to reverse-engineer the Services

7. Third-Party Services

The Services may integrate with third-party services such as email, storage, analytics, payments, or IoT platforms. Bites.com is not responsible for third-party services, their availability, or their terms.

8. Fees, Billing, and Taxes

Certain features require paid subscriptions. You agree to pay all fees, maintain valid payment methods, and handle applicable taxes.

9. Free Trials, Beta Features

Free trials and beta features are provided “as is” and may be changed or removed at any time.

10. Intellectual Property

Bites.com retains ownership of all software, technology, branding, and documentation. Feedback may be used freely without obligation.

11. Confidentiality

Each party agrees to protect the other's confidential information using reasonable care and not disclose it except as permitted.

12. Privacy and Data Protection

Bites.com’s processing of personal data is governed by the Bites.com Privacy Policy and applicable Data Processing Agreements.

13. Uptime, Support, and Service Levels

The Services are provided using commercially reasonable efforts but without guarantees of uninterrupted or error-free operation unless stated in a separate SLA.

14. Warranty Disclaimer

The Services are provided “as is” without warranties of any kind, including merchantability or fitness for a particular purpose.

15. Limitation of Liability

Bites.com shall not be liable for indirect, incidental, special, consequential, or punitive damages. Liability is capped at the fees paid in the past 12 months.

16. Indemnification

Customer agrees to indemnify Bites.com against claims arising from Customer Data, misuse of the Services, or violations of these Terms.

17. Term, Suspension, and Termination

These Terms remain in effect until terminated. Bites.com may suspend access for non-payment, violations, or security risks.

18. Data Export and Deletion

Customers may export data during their subscription. After termination, data may be retained for backups or legal requirements before deletion.

19. Governing Law

These Terms are governed by the laws of the designated jurisdiction stated by Bites.com.

20. Export Control and Sanctions

Customer agrees not to use the Services in violation of export laws or sanctions.

21. Changes to these Terms

Bites.com may modify these Terms. Continued use of the Services constitutes acceptance of the updated Terms.

22. General Provisions

These Terms constitute the entire agreement. They may be assigned, and the parties are independent contractors.
